⚖ Inheritance & Property Rights in Pakistan — Know Your Legal Rights

When someone passes away, their property and assets must be legally transferred to their legal heirs. This process is called distribution of inheritance and in Pakistan, it is governed by Islamic law as well as state law. Unfortunately, many families lose their rightful share simply because they don’t know their legal rights and options. Whether you are in Pakistan or living abroad — your inheritance rights are protected under law.

Succession Certificate — Your First Step After a Death

After a successor dies, banks, NADRA, and government offices will not transfer their accounts, assets, pension, gratuity or moveable property to anyone without a Succession Certificate. This is a legal document that officially names who the legal heirs are and what share they will get.

You can apply for a Succession Certificate through NADRA or through a civil court. LEX handles the complete process for you, including for overseas Pakistanis who cannot come to Pakistan.

Suit for Declaration — In General or When Your Inheritance Is Being Denied

If someone is claiming your share of inherited property, has forged documents, or transferred property without your consent, you have the right to file a Suit for Declaration in civil court. The court will officially declare who the real legal heirs are and what each person is entitled to. Sometimes without any denial, some authorities require a declaratory decree from court to remove the difficulty of distribution.

A court decree obtained through a Declaration Suit is legally binding across Pakistan. It can be used to cancel fake documents, recover stolen property, and force proper transfer of inherited assets. This is one of the most powerful legal tools available to heirs.

Suit for Partition — Dividing Jointly Inherited Property

In many Pakistani families, inherited property is held jointly by brothers, sisters, or cousins but no formal division is ever made. This leads to disputes, blocked sales, and years of conflict. A Suit for Partition asks the court to formally divide the jointly inherited property among all legal heirs according to their shares. Once a partition decree is issued, each heir gets their individual share — clearly defined, legally registered, and ready for use, sale or auction.

Letter of Administration — For Complex Estates

When a deceased person had company shares, insurance policies, assets in multiple cities, or property abroad, a simple Succession Certificate may not be enough. A Letter of Administration is a court order appointing a legal administrator to manage and distribute the entire estate properly. This is also the document required by banks and institutions in the UK, USA, Canada, and UAE before they release funds belonging to a Pakistani national who has passed away.

Inheritance & Property Disputes in Pakistan

Nearly 40% of all civil court cases in Pakistan involve property disputes and inheritance conflicts. The most common situations include daughters being denied their legal share, fake sale deeds or gift deeds transferring property without all heirs’ consent, one heir claiming full ownership of jointly inherited property, and caretakers claiming ownership of inherited property.

Under Section 498-A of the Pakistan Penal Code, anyone who deprives a woman of her inheritance can face up to 10 years imprisonment and a fine of PKR 1 million. The law is on your side — don’t stay silent.

Living abroad does not mean losing your inheritance rights. Through a simple Power of Attorney, LEX can represent you in Pakistani courts, apply for your Succession Certificate, file a Declaration Suit or Partition Suit, and complete property mutation — all without you needing to travel back to Pakistan.
